Welcome, and thank you for visiting Populusque ("we," "us," "our"). These Terms of Service ("Terms") govern your use of our website at www.populusque.store (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Who Can Use This Site

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order with us. By using the Site, you confirm that you meet this requirement.

2. Our Products

Each design is illustrated by our artist ahead of time. It's from these completed illustrations that we print and frame each order once you place it. Because of this:

Product images are a close representation of the finished piece, but minor variations in colour, texture, or framing detail may occur, as outlined in our Refund Policy.
We reserve the right to limit quantities, discontinue a design, or correct pricing or listing errors. If we become aware this affects your order, we'll contact you as soon as reasonably possible to offer a corrected item, an alternative, or a full refund. If you have any concerns about your order, you're welcome to reach out to us at info@populusque.store at any time.

3. Orders, Pricing & Payment

All prices are listed in US Dollars (USD) and do not include applicable sales tax, which is calculated and added at checkout based on your delivery location. We reserve the right to change prices at any time, but changes won't affect orders already placed.

Payment is processed securely through our payment provider(s) at checkout. We do not store your full payment card details, these are handled directly by our payment processor.

We reserve the right to refuse or cancel any order, for example in cases of suspected fraud, pricing errors, or unavailability of a product. If we cancel an order after payment has been taken, you'll receive a full refund.

4. Shipping & Fulfilment

Our products are printed, framed, and shipped entirely by our fulfilment partner from their facility in the United States. No goods are shipped from Norway. Estimated production and delivery times are provided at checkout and in our FAQ, but these are estimates, not guarantees, and actual delivery times may vary due to factors outside our control.

5. Returns & Refunds

Our full returns and refunds terms are set out in our Refund Policy, which forms part of these Terms. In summary: because our prints are made to order, we're unable to accept returns for change of mind, but we will replace or refund any item that arrives damaged, faulty, or misprinted.

Nothing in these Terms or our Refund Policy affects your statutory legal rights as a consumer, including your rights regarding faulty or not-as-described goods.

6. Intellectual Property

All original illustrations, designs, branding, text, and images on this Site are the property of Populusque and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our illustrations or branding without our prior written permission.

Purchasing a print grants you the right to display it for personal use. It does not grant you any right to reproduce, resell, or commercially exploit the artwork itself.

The historical graffiti our prints are based on is, to the best of our knowledge, in the public domain as ancient historical material. It is our original illustrated interpretation and rendering of that material, not the underlying historical content itself, that is protected as our intellectual property.

7. Acceptable Use

When using the Site, you agree not to:

Use the Site for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorised access to the Site, our systems, or other users' accounts
Use automated systems (bots, scrapers) to access or interact with the Site without our permission
Interfere with or disrupt the security or functionality of the Site

8. Third-Party Services

We use third-party providers to help operate our business, including but not limited to payment processing, order fulfilment and printing, and website hosting. Your use of the Site may be subject to those providers' own terms and privacy practices, which we encourage you to review.

We are not responsible for the acts or omissions of third-party providers, though we work with reputable partners and will assist in resolving any issue arising from their service wherever we reasonably can.

9. Disclaimer of Warranties

The Site and our products are provided "as is." While we take care to ensure product descriptions and images are accurate, we do not warrant that the Site will be uninterrupted, error-free, or entirely free of minor inaccuracies.

This disclaimer does not exclude or limit any statutory rights that cannot lawfully be excluded, including your consumer rights regarding faulty or misdescribed goods.

10. Limitation of Liability

To the fullest extent permitted by law, Populusque shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of our products. Our total liability to you for any claim arising from your order will not exceed the amount you paid for the relevant product.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles, reflecting the country in which the business owner is established. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Norway, even though our products are marketed to and fulfilled for customers in the United States.

This does not affect any protections you may be entitled to under the consumer protection laws of your own country of residence, where those protections cannot lawfully be waived or excluded by agreement.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
